EU proceedings against Temu

It concerns the reappearance of previously suspended “rogue traders” and systems to limit the reappearance of non-compliant goods.

The EU Commission has initiated formal proceedings against the Temu platform to investigate possible violations of the Digital Services Act (DSA) (trade-e-bility reported: EU investigates illegal Temu sellers). The issue has also been widely reported in the German daily press. The investigation is focussing, among other things, on the sale of illegal products and the systems Temu has in place to restrict the sale of non-compliant products in the European Union. These include systems to limit the re-emergence of previously suspended “rogue traders” who are known to have attracted attention in the past, as well as systems to limit the re-emergence of non-compliant goods.

This decision is based on Temu's risk assessment report and information from various sources, including national authorities.

If the allegations are true, Temu could be held liable under the Digital Services Act (Articles 27, 34, 35, 38 and 40). The Commission is planning an in-depth investigation and may take further enforcement action if necessary. The procedure does not preclude future action, for example by national consumer protection authorities.
