Ban on the sale of sky lanterns

Consumers often assume that if the product is purchased legally, its use is also authorised. This loophole is to be closed in future by amending the 15th Ordinance to the Product Safety Act.

As reported by the Bundesrat, the sale of so-called sky lanterns will be banned nationwide in future: On 15 December 2023, the Bundesrat approved a corresponding draft ordinance by the federal government.

According to the current legal situation, the use of sky or wish lanterns or lucky balloons is prohibited, but their sale is not. There is a lack of sufficient information on the prohibition of use, particularly in online retail. Consumers often assume that if they purchase them legally, their use is also permitted. This loophole is to be closed in future by amending the 15th Ordinance to the Product Safety Act.

The lanterns, described in the regulation as unmanned balloon-like flying lanterns, generate hot air through open fire. They fly uncontrolled up to 500 metres high, depending on the wind direction, several kilometres away and for up to 20 minutes. Due to their design and the materials used, they pose a considerable danger and also jeopardise air traffic, according to the official statement. The fires triggered by them can cause serious damage.

The ordinance is to enter into force on the day after promulgation. The exact date is determined by the Federal Government, as it organises the promulgation.
