European Product Act brings major changes

The European Product Act (EPA) could significantly change product law in Europe. Businesses will face stricter rules on transparency, more digital processes and greater responsibility.

Product safety, conformity and market surveillance need a more consistent legal framework. The EPA (European Product Act) wants to achieve just that for all of Europe. By doing so, it also responds to the growth of e-commerce, digitalisation and global supply chains. Essentially, data quality and transparency will be a compliance priority.

The planned Digital Product Passport (DPP), which will make product information digitally available, is vital for this effort. It will include safety information, technical documents and repair details. Accurate and complete product data will, therefore, become more important than ever. Importers must check products and documents more carefully before they enter the EU market. Retailers must ensure that product information and safety instructions are correct and respond quickly to potential risks.

EPA boosts compliance and market surveillance

The EPA aims to improve checks on products sold online and at EU borders. Online marketplaces will face greater responsibility. Furthermore, digital tools will help authorities identify non-compliant products. The EU is also considering a fee for checking imported goods. Serious violations could lead to fines of up to six per cent of a company’s global annual turnover. The EPA is expected to be adopted in the third quarter of 2026, but the legislative process is not yet complete. Businesses should start preparing by digitising product data, clarifying responsibilities, reviewing contracts and setting clear procedures for product checks and recalls.
