EU Battery Regulation: New exemptions for replaceable batteries

The EU’s battery rules could be hard to apply to some small or safety-sensitive products. The European Commission has therefore added six new product categories that can use built-in batteries. This is meant to allow products to stay safer, more durable and water-resistant while still letting trained specialists replace the battery when needed.

The EU is expanding the exemptions to its rules on replaceable portable batteries. The European Commission has added six new product categories to the list of products that do not have to let consumers remove and replace the battery.

The six new categories are:

  • Smartwatches, fitness trackers, smart glasses and wireless earphones
  • Electric toys
  • Wireless food temperature sensors
  • Equipment for potentially explosive environments (ATEX)
  • Body-worn medication delivery systems
  • Telematics devices for agricultural and construction machinery

Under the EU Battery Regulation, portable batteries must generally be removable and replaceable by consumers. However, there are exceptions where removing the battery could create safety risks or is not technically possible because of the product design. In these cases, an independent specialist must still be able to replace the battery.

The new exemptions recognise that some small, sealed devices, such as Apple Watches, AirPods and explosion-proof sensors, may need built-in batteries. A sealed design can help products stay water-resistant, durable and safe.

The European Commission has also updated its guidance on battery removability and replaceability. This should help understand and apply the new requirements.

The delegated act is now being reviewed by the European Parliament and the Council of the EU. They have two months to object. If they do not, the new battery exemptions will apply 20 days after the act is published in the EU Official Journal.
