Trading platform calls for REACh declaration: trade-e-bility offers solutions

The IT law firm IT-Recht-Kanzlei reported on 24 August 2020 that the Amazon platform currently demands statements referred to as “REACh conformity declarations” from a large number of sellers.

According to the REACh Regulation, manufacturers or importers of “products” are considered to be so-called “downstream users”. According to Art. 33 of the REACh Regulation, the central obligation of downstream users is to provide information to purchasers and consumers as to whether a product they place on the market contains a so-called “substance of high concern” in a concentration of more than 0.1 mass per cent. Only if such a declaration is issued will Amazon approve resale via its platform.
