Market Surveillance Regulation: Starting in July, every product in Germany will finally have its responsible person

With the implementation of the Market Surveillance Ordinance and the extension to include all products under the Market Surveillance Act in Germany, each product must now have a person responsible for its safety and market conformity from 16 July this year.

With the implementation of the Market Surveillance Ordinance and the extension to include all products under the Market Surveillance Act in Germany, each product must now have a person responsible for its safety and market conformity from 16 July this year. The legislative amendment also imposes product responsibility on fulfilment service providers and marketplace operators in particular. However, operators affected may delegate some of their obligations to an authorised representative and obtain full assistance, even in the event of measures being imposed by market surveillance authorities, by appointing such an authorised representative. Numerous platform operators have adopted this approach and only give access to non-European traders with a contractually obliged authorised representative.

When selecting an authorised representative, it is important to take into account the scope of services to be provided. An authorised representative must be reliably available throughout the life cycle of the product.
