Certain food containers are not single-use plastic articles

Accordingly, “containers of food in portion sizes for more than one person or containers of food in portion sizes for one person where more than one unit is sold” are no longer covered by Directive (EU) 2019/904 and are therefore exempt from its restrictions.

The EU’s intention behind Directive (EU) 2019/904 was to reduce the volume of single-use plastic items. Exactly which products were affected was described in greater detail in a separate guideline. This guideline was corrected on 8 April 2022. Accordingly, “containers of food in portion sizes for more than one person or containers of food in portion sizes for one person where more than one unit is sold” are no longer covered by Directive (EU) 2019/904 and are therefore exempt from its restrictions. Manufacturers or importers of such disposable articles can take advantage of this with immediate effect.
